    My question involves workers compensation law for the state of: Texas

    I recently returned to USA after working in South America for the past 4 years. I was working for an American company based in Texas. Honestly I don't know if they paid taxes or not in Texas (probably not) since they would send my check to the latin country where I was working. My job was to open a project that included opening an office (to do so, I had to do everything in my name since a signature was required) They promised me a salary and a % once we started production. Meanwhile, I was given a salary + they were covering my local expenses (food, lodging and transportation) While working in the latin country, I had to divide my salary in 2 to be able to pay taxes in the states and in the latin country. Last year in september, the company owners send me an email saying to close everything down, pack and leave the country, they had run out of money and the project was closed down. I was running a company 4 employees in the city and about 30 in the field. We were in the middle of production when that happened. I explained to them that it was not the procedure and I had to pay everyone before closing and that I needed time to closed down our contracts. (which they were all in my name) that I requested at least two months to do so. They denied my petition so I talked to the company's lawyer, I explained he situation and he explained what could happened if things don't get paid plus since my name was in everything... they would go after me. He wrote to the owners and explained the situation.... No answer was given to him either. The owners in Texas send a letter resigning from the project and any liabilities with the project. So, I decided to stay finish the production and try to sell everything to cover all the issues pending... I managed to supervise the production and the delivery of the product on my own and I fulfill the contract. After that, I sold as much as I could to cover salaries and compensations to workers. I finalizing everything on April 2014 and was able to travel end of May. I have been working without a salary since last September (2013) and managed to return to the states end of May 2014. I don't have a job, those people in Texas won't even talk to me nor pay me what they owed me or anything. The first year I was given a contract but never renew it after that... Daily communication continued, they kept wiring money for the project and everything was great until they send an email where I was left hanging in another country and with no money and with lots of responsibilities. I am in Oregon living with my daughter at the University and with no job. I can't get a job that pays me enough to even cover her studies. Can I claim unemployment from an overseas job?

    Normally. no. But without knowing if your employer paid into unemployment for you, there's no way to say for certain. The best way to find out would be to file for unemployment. You'll find out soon enough.

    I think the issue is even more complicated. As you were released by the company and took it upon yourself to continue running the operation, you could be deemed self employed at the end.

    And given that under the best of circumstances there would have been nothing paid in since September and it's unlikely that her employer was required to pay anything in, in the first place, any benefit she does qualify for is going to be tiny, at best. The maximum benefit in Texas is $454 per week and under the circumstances she's described, she will not be getting the maximum benefit even assuming she gets anything at all.

    Yes, very complicated. I had no choice to continue and finish the job. My name (head) was on the line and I could had been stop from leaving the country. Not very ethical when they told me to closed down and run! I gave 100% to this job and trusted them, even risked my life doing so.

    Deemed self employed... Are they any benefits? I mean, the company in Latin America is legally 100% under my name now and there are several properties...Any benefits I can get at all?

    Being self employed is a bar to unemployment. It does not help your claim - it hurts it.

    I suggest you get the proper IRS forms filed or you can be fined tens of thousands of dollars based on your posted information.
